Failure to recertify operates as a revocation of the license. Under the NY SAFE Act, if a licensee at any time becomes ineligible to obtain or hold a license, the license is deemed revoked and, under NY Penal Law § 400.00(11)(c), the licensee is required to surrender (1) his or her license, and (2) his or her firearms, not just the licensed firearm(s), to law enforcement.
